# LocalBrain 服務條款 / Terms of Use **最後更新：2026-05-05** **Effective date: 2026-05-05** --- ## 中文版（繁體中文） 歡迎使用 LocalBrain（以下簡稱「本 App」）。下載、安裝或使用本 App 即代表你同意以下條款。 ### 1. 服務性質 本 App 是一款**個人知識庫工具**，使用本機 AI 模型協助你整理、檢索、改寫筆記。所有 AI 推論在你的裝置上進行，不依賴任何雲端 AI 服務。 ### 2. AI 生成內容免責聲明 - AI 模型可能**產生不準確、過時或錯誤的內容**（俗稱 hallucination） - 本 App 提供的回答**僅供個人參考**，**不構成醫療、法律、財務、投資、心理健康等專業建議** - 對於 AI 產出內容的正確性、完整性與適用性，使用者需自行判斷與驗證 - 我們**不對 AI 產出造成的任何決策後果負責** ### 3. 內容責任歸使用者 - 使用者自行負責匯入到本 App 的所有內容（網頁、檔案、筆記） - 不得匯入侵犯他人著作權、隱私、商標權的內容 - 不得使用本 App 從事違法活動、產生違法內容、騷擾他人或散布仇恨言論 - 違反 [Gemma Prohibited Use Policy](https://ai.google.dev/gemma/prohibited_use_policy) 即同等違反本條款 ### 4. 模型授權 本 App 使用 Google Gemma 4 E2B 模型，依 Apache 2.0 授權及 Gemma 專屬條款散布： - 授權條款：[Gemma 4 License](https://ai.google.dev/gemma/docs/gemma_4_license) - 使用條款：[Gemma Terms of Use](https://ai.google.dev/gemma/terms) - 禁止使用政策：[Gemma Prohibited Use Policy](https://ai.google.dev/gemma/prohibited_use_policy) 使用本 App 即同意上述所有條款。 ### 5. 智慧財產 - 本 App 由 **TheOriCode** 擁有 - 使用者匯入的內容著作權屬於原作者，不因匯入本 App 而轉移 - 開源元件（MLX-Swift、SQLite、SwiftUI 等）依其原授權條款使用 ### 6. 服務變更與終止 - 我們可能在新版本更新功能、調整介面、移除實驗性特性 - 我們**不保證 R2 模型 mirror 永久可用**——若 mirror 不可用，App 仍可選擇從 HuggingFace 直連下載（旗標切換） - 使用者可隨時刪除本 App 終止使用，本機資料一併移除 ### 7. 沒有保證 本 App **以「現狀」(AS IS) 提供，不附帶任何明示或暗示的保證**，包括但不限於適售性、特定用途適合性、不侵權的保證。在法律允許的最大範圍內，我們不對任何直接或間接損害負責。 ### 8. 準據法 本條款依**中華民國（台灣）法律**解釋與適用，以台灣台北地方法院為第一審管轄法院。 ### 9. 聯絡 問題或意見：**support@theoricode.com** --- ## English Version Welcome to LocalBrain (the "App"). By downloading, installing, or using the App, you agree to these terms. ### 1. Nature of the service The App is a **personal knowledge management tool** that uses an on-device AI model to help you organize, search, and rewrite notes. All AI inference happens on your device with no dependency on cloud AI services. ### 2. AI-generated content disclaimer - The AI model may **produce inaccurate, outdated, or incorrect content** (so-called hallucinations) - Answers from the App are **for personal reference only** and **do not constitute professional medical, legal, financial, investment, or mental health advice** - Users are responsible for evaluating and verifying any AI output before relying on it - We are **not liable for decisions made based on AI output** ### 3. User-imported content - You are responsible for any content (webpages, files, notes) you import into the App - You may not import content that infringes copyright, privacy, or trademark rights of others - You may not use the App for unlawful purposes, to generate unlawful content, harass others, or spread hate speech - Violation of the [Gemma Prohibited Use Policy](https://ai.google.dev/gemma/prohibited_use_policy) is a violation of these terms ### 4. Intellectual property - The App is owned by **TheOriCode** - Content you import remains the property of its original copyright holder - Open-source components (MLX-Swift, SQLite, SwiftUI, etc.) are used under their respective licenses ### 6. Changes and termination - We may update features, change UI, or remove experimental capabilities in new releases - We **do not guarantee perpetual availability of the R2 model mirror** — if it becomes unavailable, the App can fall back to a HuggingFace direct connection (toggle flag) - You may stop using the App by deleting it; all on-device data is removed ### 7. No warranty The App is provided **AS IS, without warranty of any kind**, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we are not liable for any direct or indirect damages. ### 8. Governing law These terms are governed by and construed in accordance with the **laws of Taiwan (Republic of China)**, with Taipei District Court as the court of first instance. ### 9.
